Terms of Use / EULA

1. Eligibility and family use

Third Arm is intended for general audiences and may be used by children and adults. If you are under the age at which you can legally agree to these terms in your region, your parent or legal guardian must review and accept these terms for you and supervise your use where required by law.

Optional third-party AI tools that you connect through Pro+ may have their own age restrictions or parental consent rules. Those rules are separate from Third Arm.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Third Arm on your compatible Apple devices for your personal productivity and organization needs, subject to these terms.

If you downloaded Third Arm from the Mac App Store, your use is also subject to Apple's App Store terms, including Apple's standard licensed application terms where applicable. Apple is not responsible for maintenance or support for Third Arm; contact us using the email below for support.

3. Local-first use and Sign in with Apple

Third Arm is local-first. You can use the core app without creating an account. Your notes, reminders, and other card data are stored on your Mac by default.

Optional cloud sync (a Pro feature) uses Sign in with Apple only. Email/password and Google Sign-In are not used for new sync. Signing out or turning sync off keeps your local data on this Mac.

When sync is enabled, content is synced through your Apple iCloud / CloudKit private database under your Apple ID. Apple provides that infrastructure under Apple's terms and privacy policy.

4. Your content and sync

You retain ownership of the content you create in Third Arm. We do not host your card data on our own servers. Local files stay on your device unless you opt into Pro sync, in which case copies may be stored in your iCloud private database so they can sync across your signed-in Macs.

You are responsible for your own backups and for managing iCloud storage associated with your Apple ID. Turning sync off or signing out does not delete local data on the Mac you are using.

5. Paid plans and Apple billing

Third Arm offers Free, Pro, and Pro+ plans. Paid plans are billed by Apple as in-app subscriptions. Purchases and restores use StoreKit and your Apple ID; they do not require a separate Third Arm cloud account.

• Free includes the core app with lower storage limits, main-window focus timers, and quick actions such as clipboard history, the calculator, text transform, system status, world clock, QR generation, single-file image convert, and single-file PDF compress. Data stays on your Mac.
• Pro adds higher limits, optional iCloud sync (Sign in with Apple), the Summary page, appearance upgrades, and Pro quick actions such as snippets, natural-language capture, the Today glance, QR scanning, image batch convert, PDF merge / batch compress, and the menu bar Timer shortcut with a floating focus overlay.
• Pro+ includes everything in Pro plus optional AI Connect: a private local endpoint on your Mac and optional snapshot export for use with your own external AI tools.

Paid plans renew automatically until canceled through your Apple account settings. Signing out of Sign in with Apple or deleting sync credentials in Third Arm does not cancel your Apple subscription.

6. Optional AI Connect and third-party tools

Third Arm does not run AI by default and does not bundle a model provider. If you subscribe to Pro+, you may optionally enable AI Connect — a private local endpoint on your Mac (not a web-hosted API) for one-click use with tools such as Cursor or Claude Desktop — and/or copy or export an on-device snapshot for other tools.

If a connected tool fetches that local endpoint, or you paste or upload a snapshot into a third-party tool, that provider's own terms, privacy policy, billing rules, and age rules apply. Those optional flows are user-initiated and are not part of the Free or Pro plans. Third Arm does not store your OpenAI or Anthropic API keys, and does not host a public cloud AI context API for the app.

7. Restrictions

You may not use Third Arm for unlawful purposes, attempt to interfere with the service, access another person's data without permission, or use the service in a way that harms us or other users.

8. Intellectual property

Third Arm, excluding your content, is owned by us or our licensors and is protected by applicable intellectual property laws. You retain ownership of the content you create inside the app.

9. Account deletion and termination

You can sign out of Sign in with Apple and turn off sync from Settings. Local card data on your Mac is kept unless you delete it yourself. iCloud copies, if any, are managed through your Apple ID / iCloud settings.

We may suspend or terminate access to paid features or the website if you violate these terms or if continued access creates legal or security risk.

10. Website hosting

This marketing website (and related static pages) may be hosted using Firebase Hosting or similar infrastructure. Website hosting is separate from app data storage. The Mac app does not use Firebase Authentication, Firestore, or Cloud Functions for your notes or sync.

11. Disclaimers and limitation of liability

Third Arm is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of local or iCloud data. Our total liability for claims arising from the service will not exceed USD $100.

12. Governing law

These terms are governed by the laws of Hong Kong, without regard to conflict of law principles, except where local consumer law requires otherwise.

13. Changes

We may update these terms from time to time. Changes will be posted here with a new date. Continued use after changes means acceptance.
